Terms and Conditions

  Our aim is to be as professional, efficient and courteous as possible with both our customers, and suppliers. In these terms and conditions "we" and "us" relates to FUNBREAKS (The Company), "You" means the person making the reservation and "group" includes all people travelling with you (The Client). It is assumed that you are the lead contact for your group and that all correspondence or conversations will take place between you and us. You as the Lead Customer are liable for payment of the amounts due and therefore are responsible for collecting all monies and making payments to us by the due date.

Prices
The price of your Program is as detailed in the Booking Confirmation. FUNBREAKS reserves the right to change the price of the Program at any time prior to the issuing of the Booking Confirmation. All prices referred to are in pounds sterling. We accept payment by all the major credit and debit cards and you can pay in Pounds, Euros or U.S. Dollars. We use a company called Paypal to process your payments securely online. You can read more about them via their website www.paypal.com. You can also pay us directly into our Bank account. We never come into contact with your card at anytime and we will never know any details of the card(s) you use to pay us with.

Booking
Upon discussion all requirements with you, we will we will endeavour to provide you with a copy of a proposed itinerary, a quotation per person and a copy of our terms and conditions. Full confirmation of your booking can only be taken in writing by letter, fax or e-mail and upon receipt of this you will be given a booking reference number. It is imperative that you provide details of each traveller correctly. In making a booking with us, acceptance of our booking terms and conditions is understood and that the person making the booking is responsible for making all parties aware of these conditions.

Deposit and Payments
A non-refundable deposit of 20% of the total amount plus the cost of any required insurances must be paid immediately upon confirmation of booking. Once we have received a deposit payment from you (or payment in full for late bookings) we will issue a confirmation receipt. The remaining payment is to be made 49 days prior to the arrival date or by such date as is specified in the Booking Confirmation. In the case of Bookings made less than 48 days prior to the arrival date the full amount is payable upon booking. If you faille to pay a full balance by the due date we are entitled to cancel your booking and retain your deposit.

Changes made by you
All changes must be notified to us in writing immediately. If the Client wants to change the Program or the numbers or members (changes in group size are likely to influence prices) after the Booking Confirmation has been issued then there is a charge of £20.00 (per change) payable together with any charges or costs imposed by the Suppliers.
Daytime, evening programmes, transport-if the Client arrives later than 15 minutes from the start of any confirmed programme time or fails to show up unless prior written notice has been given the Supplier is entitled to assume the booking has been cancelled, standard cancellation terms will apply.

Cancellation by you
In case the client cancels the ordered accommodation and/or services, following cancellation fees apply:

More than 60 days before departure Deposit
Between 59 and 40 days before departure Deposit plus 30% of remaining balance
Between 39 and 30 days before departure Deposit plus 45% of remaining balance
Between 29 and 16 days before departure Deposit plus 70% of remaining balance
Less than 15 days before departure Deposit plus 100% of remaining balance

Cancellation will only be effective from the date that written notification of cancellation is received by FUNBREAKS. The positive difference between the price paid by the client and charged cancellation fees will be returned by FUNBREAKS to client, preferably in the same way as the payment has been realised by the client.

Cancellation by us
If an event within a package, which we organise, becomes unavailable we will have the choice of replacing it with an alternative activity (in consultation with you), or making a proportional refund. You will not be entitled to cancel the booking. If the event is a subsidiary and not a main part of any package, we will not be obliged and you will not be entitled to cancel your booking. Please note that to qualify for a refund, we must receive a request in writing. We reserve the right to change accommodation to other accommodation of similar quality with similar access to any activities that we agree to arrange. FUNBREAKS reserves the right to cancel your and your groups holiday up to and including 60 days before your arrival date.

Price Changes
In the unlikely event of price changes on the side of Suppliers, we will aim to inform you no later than 60 days before your and your group's arrival date. You are then entitled to cancel your holiday and receive a full refund of monies paid to FUNBREAKS or cancel certain parts of your booking. If you failled to respond within 7 days to our price change notice we will assume that you and your group have accepted the new price conditions. We are obliged not to change any price of your holidays reserved within 60 days of departure. The changes in group size are subject to price alteration.

Activities
Whilst me make every effort to ensure that the activities we provide are as specified on the website, occasionally, for whatever reason, these might change. Wherever possible we will attempt to keep you informed of any discrepancies.

Surcharges
The following areas are liable for surcharge: government action and currency. Please note the holiday price does not include visa charges and amendment fees.

Force Majeure
Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by Force Majeure. Additionally we cannot accept liability or pay any compensation where you suffer any damage or loss as a result of Force Majeure. "Force majeure" includes: war, threat of war, riots, civil disobedience or strife, industrial dispute, terrorist activity, acts of god, natural or nuclear disaster, fire, adverse weather conditions, level of water, technical or maintenance problems with transport and changes of schedules or operational decisions of transport providers, closure of airports or any unforeseeable or unavoidable event beyond the control of FUNBREAKS or its suppliers. Refunds will not apply in the case of weather dependent activities beyond our control
(Parachuting, Skiing, Ballooning etc).

Liability
FUNBREAKS undertakes no liability for any act, omission or default, whether negligent or otherwise, of any of our suppliers or third party. All activities that you and your group partake in as part of your FUNBREAKS package are undertaken at your own risk; we accept no liability for any illness, personal injury or death to you or any member of your group. If you are late for transfers you are liable to pay additional charges incurred by us as a result of your lateness. FUNBREAKS is not a provider of services and has no responsibility for services provided or not provided by any party. We give and make no warranty or representation regarding the standard of any service or product to be supplied and no person has authority to make any such representation or warranty on behalf of FUNBREAKS.
FUNBREAKS is also not liable for any loss or damage related neither to the accommodation, nor for the availability and conditions of the accommodation itself.

Insurance
FUNBREAKS recommends all clients to conclude relevant travel insurance effective for the whole duration of a trip. FUNBREAKS shall not be liable for any health problems, accidents or other injury, loss of luggage or damage caused to a third party. For any activity you and your group participate in during your trip, you and your group do so at your own insurance responsibility and any claims must be directed at the company providing the service. We take no responsibility for our suppliers. It is your responsibility to sign disclaimers presented to you for any activities deemed to be high-risk: e.g.: snowmobiles, quad-biking, rifle shooting etc. You must make us and our suppliers aware of any medical circumstances that may affect your safety or health whilst participating in any activities.

Data Protection
The client acknowledges that in order to fulfil the contract, FUNBREAKS collects the personal data necessary for realization of the contract and for marketing purposes. The client is entitled, upon request, to be informed by FUNBREAKS which of his/her personal data are stored by FUNBREAKS and to demand the personal data to be changed in case they are incorrect or retrieved illegally or to be deleted from the database.

Behaviour
As a FUNBREAKS customer you are expected to behave in a safe and courteous manner at all times. You must ensure you arrive on time for all events, obey all instructions given to you by activity leaders and dress appropriately for your activities. You are not permitted to arrive at any accommodation or activity suppliers under the influence of alcohol or drugs under any circumstances. FUNBREAKS will not be liable for any refusal of entry or participation in an activity if your group fails to conduct yourselves as detailed in this clause. Certain accommodation and event suppliers insist on a behavioural bond to be deposited by the group on arrival. Management may refuse your group entry without this bond and FUNBREAKS will not be liable for your arrangements if this clause is not adhered to, or if the management refuse entry. You also agree to compensate our contractors or us for any damage or loss of revenue caused by you in the course of an event.

Claims and Complaints
In case any short-coming or defect occurs by provision of accommodation or services ordered, the client must immediately inform the supplier and require remedy on place or, if this is not possible, contact with the claims and complaints FUNBREAKS via the Email: info@funbreaks.eu.FUNBREAKS will subsequently start to deal with the reported complain, using all means available to resolve the reason of the claim and inform the client of settling the claim within 30 days after its receipt.

Final provisions
These terms and conditions govern the relationship between the client and FUNBREAKS and shall be valid for all cases unless explicitly agreed by both parties in written differently. Concluding the contract, the client confirms his/her acquaintance with these terms and conditions and their full acceptance. All other issues not regulated in these terms and conditions shall be governed by the applicable legislation valid in Poland.
